These terms govern every purchase through nmcrelax.com. Please read them before ordering — placing an order means you accept them.

1. The seller

Nicolás Martínez Carrasco, trading as NMC Relax, registered self-employed (autónomo) in Spain, NIF 79054182P, Calle Henao 21, 4º A, 48009 Bilbao, Bizkaia, Spain. Email: help@nmcrelax.com.

2. Who can buy

You must be at least 18 and legally able to enter a contract. We sell to consumers, not for resale.

3. The product, and what it is not

The Atruvate Cervical Pillow applies adjustable heat, adjustable vibration and a contoured cervical rest.

It is a wellness device, not a medical device. It is not intended to diagnose, treat, cure or prevent any disease or condition, it is not certified medical compression or traction equipment, and it does not replace assessment or treatment by a qualified healthcare professional. Nothing on this website is medical advice.

Consult a doctor before use if you are pregnant, have a pacemaker or other implanted device, have had recent neck surgery or injury, or live with osteoporosis, thrombosis or clotting disorders, reduced skin sensation, diabetes-related neuropathy, or an active skin condition on the neck. Stop using it and seek advice if use causes pain, dizziness, numbness or tingling.

Individual experience varies. Descriptions of how the device feels reflect typical use and are not a guarantee of any particular outcome for you.

4. Prices and how a contract is formed

Prices are displayed in US dollars and include Spanish VAT where applicable. Displaying a product is an invitation to treat — the contract forms when we send your order confirmation email, not when you click buy.

We may refuse or cancel an order where an item is out of stock, where there has been an obvious pricing or description error, or where we suspect fraud. If we cancel after payment, you receive a full refund promptly and without having to ask.

Where a struck-through comparison price is shown, it is a price at which the product was genuinely offered for a substantial preceding period.

5. Payment

Taken at checkout through Shopify Payments and the providers offered there. We do not see or store full card details. Goods remain our property until paid for in full.

6. Delivery

Timescales and carrier information are in our Shipping Policy, which forms part of these terms. Risk in the goods passes to you on delivery.

7. Right of withdrawal (consumers in the EU/EEA)

You may withdraw within 14 calendar days of the day you or someone you nominate takes physical possession of the goods, without giving a reason.

Tell us clearly before the 14 days expire, by email to help@nmcrelax.com. The model withdrawal form in our Refund Policy is available but not compulsory.

Return the goods within 14 days of telling us. We refund all payments received, including standard outbound delivery, within 14 days of receiving the goods back or of your proof of return, whichever is earlier, by the same payment method you used.

You are liable for any reduction in value from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. For this product that means: unbox it, plug it in, use it a few times. That is exactly what we want you to do.

Beyond the statutory 14 days we voluntarily offer a 30-day return window. That is our own commercial promise, additional to your legal rights, and it does not replace them.

8. Legal guarantee of conformity

Under Spanish Royal Legislative Decree 1/2007 as amended by Royal Decree-Law 7/2021, consumers have a three-year legal guarantee from delivery for goods not in conformity with the contract. In the first two years, a lack of conformity is presumed to have existed at delivery unless we prove otherwise.

Where goods are faulty you may require repair or replacement, and where those are impossible, disproportionate or not carried out within a reasonable time, a price reduction or termination of the contract. These rights are free of charge and additional to section 7, and additional to the 1-year commercial warranty we offer against manufacturing defects.

Fair wear and tear, damage from misuse, damage from ignoring the care instructions, and damage from submerging the unit in water are not lack of conformity.

9. Our liability

We are liable for foreseeable loss caused by our breach of these terms. We are not liable for business losses or for loss that was not foreseeable when the contract was formed.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded — including consumers' mandatory statutory rights.

10. Reviews and testimonials

Any review published on this site is written by a person who bought the product from us. We do not publish invented reviews, we do not publish incentivised reviews without disclosing the incentive, and we do not delete negative reviews to inflate an average. Where no reviews are shown, it is because we do not yet have any.

11. Complaints

Email help@nmcrelax.com. Complaints reach the owner directly. Escalation routes are in our Legal Notice.

12. Governing law

Governed by Spanish law. Where you are a consumer you also have the benefit of mandatory protections of your country of habitual residence. Disputes may be brought before the courts of the consumer's domicile.

13. Changes

The version applying to your order is the one published when you placed it.
